Document every option you presented.

Here’s the thing. Non-commissionable plans aren’t new, but 2027 puts a lot more of them in front of agents at once. Decide how you’ll handle it now, not at the kitchen table.

What are non-commissionable Medicare Advantage plans and which carriers are doing it for 2027?

A non-commissionable plan is one the carrier keeps selling but doesn’t pay agents for when they write new enrollments. The plan stays on the market and the client can still enroll in it. The only thing that changes is that you don’t get paid for the new enrollment.

Aetna is the biggest example on record. Medical Daily reports that Aetna told marketing organizations it “will not pay commissions to agents and brokers who enroll new members in 123 Medicare Advantage plans across 33 states for the 2027 plan year,” covering nearly 780 counties. An Aetna spokesperson told Becker’s Payer Issues that the company changed “certain plans to non-commissionable starting on September 15, 2026, and certain other plans starting on January 1, 2027.”

Humana is the other name you’ll hear. Brokers report Humana has more than 300 MA and PDP plans at $0 for 2027, according to commission.health’s carrier tracker, which labels that figure as reported rather than confirmed. Treat it the way you’d treat any secondhand number and check your own contracts.

What’s driving this? Carriers use commission status to manage enrollment. Becker’s frames it this way: making a plan non-commissionable “effectively removes it from the sales conversation and disincentives new enrollment without formally exiting the market,” and carriers have been “prioritizing margins over enrollment.” It’s a business decision. Your job is to understand how it works, not to take it personally.

A few facts to keep straight:

The plan isn’t discontinued. If it’s the plan that best fits the client’s needs, you can recommend it, and you should. Getting zero commission on a plan doesn’t change anything about how you present options to a client.

Let me show you what I mean. Say a client takes three maintenance medications and has a specialist they won’t give up. After you run the drugs and check the network, one plan clearly comes out ahead. If that plan is non-commissionable, it’s still the plan that fits. Leaving it out, or pushing it to the bottom of the list, would mean letting your paycheck shape the recommendation.

A zero-commission enrollment is real work for no direct pay. But a client who got the right answer from you is a client who calls you next year and sends you their neighbor.

What does CMS say about steering based on compensation?

CMS’s position is that compensation should never pull a client away from the plan that best meets their needs. That rule is written into the statute. So steering a client away from their best-fit plan because it pays you less, or pays nothing, is a compliance problem.

The CMS final rule fact sheet for contract year 2025 says “the Medicare statute requires that CMS must establish guidelines to ensure that the use of compensation creates incentives for agents and brokers to enroll individuals in the Medicare Advantage or Part D plan intended to best meet the prospective enrollee’s health care needs.” It also names the risk directly: individuals “being steered to some Medicare Advantage and Part D plans over others based on the agent or broker’s financial interests.”

Affordable Care Agents says it plainly: “Compliance obligations do not change based on commission levels.” Agents who steer clients away from a plan that’s actually in their best interest “solely because it carries lower compensation” are taking on compliance risk.

In practice, that means you never:

Leave a plan out of your comparison because it doesn’t pay.

Tell a client a plan “isn’t available” when it is.

Say a plan is “going away” or “being phased out” when there’s been no discontinuation.

Downplay a plan’s fit for the client so it looks weaker than it is.

Clients can see every plan in their county on Plan Finder, so an omission tends to come out eventually.

How do I check commission status before an appointment?

Check commission status during prep, before you sit down with the client.
